uDirect IRA Services, LLC Texting User Agreement
This uDirect IRA Services, LLC Texting User Agreement (the “Agreement”) applies to your use of our Self-Directed IRA offerings (the “Service”) provided by or on behalf of uDirect IRA Services, LLC. By using the Service, you agree to the below terms and conditions.
- The uDirect IRA Services, LLC text service is intended to provide you with text messages regarding your request to learn about opening an account, additional follow-up, information regarding your established IRA account, missing documentation, status of a transaction, outstanding requirements or other account related or educational information.
- To start the service, you will receive a text message asking you to reply “Yes” to opt-in. Message & data rates may apply. Service available on participating carriers only. By opting in to this service, you verify your mobile phone number provided and consent even if your phone number is registered on any state or federal Do Not Call list. Consent is not a condition of purchasing products or services and you may revoke your consent by texting ‘STOP’ at any time to the original number that contacted you, contacting us by phone at (714)-831-1866 or by email at info@udirectira.com.
- There is no fee from uDirect IRA Services, LLC to receive messages. Message & data rates may apply– this can be checked with your mobile service provider. You are responsible for any applicable charges when you opt-in for the Service. Charges are billed and payable to your mobile service provider or deducted from your prepaid account. Consent is not a requirement for purchase.
- Text message frequency may vary based on activity within your account or frequency of following up on your initial inquiry.
- Data obtained from you in connection with this SMS service may include your cell phone number, your carrier’s name and the date, time, and content of your messages. uDirect IRA Services, LLC may use this information to contact you and to provide the services you request from us. You agree to provide us with your valid mobile phone number. If you get a new mobile phone number, you will need to sign up for the Service with your new number.
- uDirect IRA Services, LLC will not be liable for any delays in the receipt of any SMS messages as delivery is subject to effective transmission from your network operator.
- The Service is available on US carriers only and is subject to change at any time without notice to you.
- As a subscriber of the Service, you will receive text messages to the mobile phone number provided. You can unsubscribe from this Service at any time by texting ‘STOP’ to the original number that contacted you, contacting us by phone at (714)-831-1866 or by email at info@udirectira.com.
- If you have any questions, text HELP to the original number that contacted you, contacting us by phone at (714)-831-1866 or by email at info@udirectira.com.
- Alerts sent via SMS may not be delivered if the mobile phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of the wireless carrier may interfere with message delivery, including the customer’s equipment, terrain, proximity to buildings, foliage, and weather. The wireless carrier does not guarantee that alerts will be delivered and will not be liable for delayed or undelivered messages.
- uDirect IRA Services, LLC reserves the right to suspend or terminate the Service at any time without notice to you. This Agreement may be revised at any time. If you continue to use the Service after receiving this notice, you thereby agree to the updated Agreement. uDirect IRA Services, LLC reserves has the right to change our telephone numbers (including but not limited to, short and long codes.) You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number uDirect IRA Services, LLC has changed may not be received and uDirect IRA Services, LLC will not be responsible for honoring requests made in such messages.
- You will indemnify, defend, and hold us, uDirect IRA Services LLC, and their respective employees, principals (shareholders or holders of an ownership interest, as the case may be), service providers, and agents harmless from and against any and all losses, damages, costs, expenses (including court costs and reasonable attorneys’ fees), judgments, assessments, fines, and other liabilities arising out of or resulting from any third party claims or suits arising out of or resulting from Your failure to comply with the terms and conditions of this Agreement.
