Subject: Urgent Request to Oppose AB 130 Due to Harmful Language from SB 681

I am a constituent residing in [Your City], and I’m writing to express my strong opposition to a provision recently added to the state budget trailer bill, AB 130, which incorporates language from SB 681. This language would effectively make junior trust deeds and second-position real estate loans unenforceable in California, even retroactively.

As someone who [choose one: invests in trust deeds through a Self-Directed IRA, is a small lender supporting California’s housing market, provides seller-financing options to homebuyers, helps clients with non-bank lending solutions], I am deeply concerned about the devastating impact this bill would have on:

  • Retirees who rely on these investments for income

  • Small lenders and real estate professionals

  • Legal certainty in the real estate market

  • Property rights and due process

This provision would:

  • Deem certain junior loans “abandoned” with vague and unfair criteria

  • Make it nearly impossible to foreclose, even when borrowers default

  • Retroactively allow courts to set aside past foreclosure sales

  • Undermine confidence in California’s property and lending laws

This bill creates instability, chills private lending, and erodes investor confidence in California real estate. If left unchanged, it will dry up a vital source of funding for housing and inflict losses on thousands of law-abiding investors and retirees.

Please do not support AB 130 unless the SB 681 language is removed or amended. At the very least, carve out commercial-purpose loans and protect legitimate trust deed investors.
